Early Neutral Evaluation
This ADR technique is the simplest and very often the quickest. Our Evaluator will examine the parties evidence submitted. After examination we will provide the parties to the dispute with an objective, non-binding recommendation of how we consider the dispute would be resolved if it were to be referred to adjudication, arbitration or litigation.
The evidence required in a submission is not normally as in-depth as in formal proceedings. This process is there to provide the parties with an impartial, initial assessment of the dispute at a reasonable cost and to assist the parties in their negotiation of a settlement.
It might be that before or after a recommendation is offered during this process the parties may agree to refer the matter to mediation.
Much like mediation our recommendation is non-binding, however again as in mediation the recommendation we give can become binding should both parties decide or if the recommendation is not rejected within an agreed timescale.
ConstructPRO act as Neutral Evaluators in many disputes, providing Expert advice. Read about our experience in Early Neutral Evaluation.
